Common drug offenses and penalties in Florida

  • Marijuana — Possession of 20 grams or less of marijuana is a misdemeanor with a possible jail sentence of up to one year plus fines. For first-time offenders, the court often allows enrollment in a pretrial diversion program. Possession of vast quantities leads to felony trafficking charges, with a potential prison sentence of up to 30 years and fines of up to $200,000.
  • Cocaine — Possession of a small quantity, which need only be cocaine residue in a baggie, is a felony carrying up to five years’ in prison and a $5,000 fine. Trafficking in cocaine is a serious felony and is punished much more severely, with sentences ranging from three years in prison to life, depending on the amount of cocaine involved.
  • MDMA — Possession of more than 10 grams of Ecstasy is trafficking, a felony that carries a mandatory minimum of three years in prison and a $50,000 fine. Greater amounts can earn a minimum of 15 years in prison and a fine of $250,000.
  • Prescription medication —Possession and trafficking of unauthorized prescription drugs, such as OxyContin or steroids, are serious felonies. Simple possession has a maximum penalty of up to five years in prison. Trafficking carries substantial mandatory prison time based on the amount of drugs seized.
